Statements of fact you are on the hook for

Assertions each party makes about itself and the subject matter — that it has authority to sign, that it owns what it is licensing, that the software does what the documentation says. If one proves untrue the other side has a claim, which is why the qualifiers attached to them (“to the best of its knowledge”, “material”) matter as much as the statements themselves.
